No fiscal implication to the State is anticipated.
The bill would create as a misdemeanor offense with a fine of between $1 and $200 the act of a motor vehicle passing a bicyclist without vacating the lane in which the bicyclist is riding if on a highway with two or more marked lanes, of not passing at a safe distance, or of not slowing to a speed not to exceed 30 miles per hour. If the offense results in property damage, the offense would be punishable by a fine of $500. If the offense results in bodily injury, the offense would be a Class B misdemeanor. The bill would take effect September 1, 2005.

No significant fiscal implication to units of local government is anticipated for enforcement, prosecution, or punishment for the offenses.
