No significant fiscal implication to the State is anticipated.

The bill would amend the Code of Criminal Procedure by allowing peace officers of designated police agencies to possess and operate, install, or monitor a pen register. The bill defines a designated police agency as a police department in a municipality with a population of 500,000 or more. The bill would also repeal Article 18.20 of the Code of Criminal Procedure, which requires the act to expire in September 2005. The Office of Court Administration and the Department of Public Safety have determined that the cost to the state of implementing the provisions of this bill would not be significant.
