The bill would amend the procedures for setting an execution date or for appealing a trial court decision ordering the execution of a person who the trial court has determined is not incompetent to be executed. The bill would take effect September 1, 2005 and would apply only to a motion filed on or after that date.
According to an analysis by the Court of Criminal Appeals, the proposed change in procedures would not result in a fiscal impact on the court.
