No significant fiscal implication to the State is anticipated.
The bill would amend portions of Chapter 37, Education Code related to the notice provided to educators associated with a student's misconduct and with placement of a student who has assaulted a teacher. The bill would require the teacher’s consent before a student could return to the teacher’s classroom who was placed in a disciplinary alternative education program (DAEP) or was expelled for an assault against the teacher. The student could return to the classroom without the teacher’s consent only if there were no other options for placement within the school district.The bill would apply beginning with the 2005-06 school year.
Local Government Impact
Similar notice is required under current law for teachers of students who have been expelled for serious offenses; therefore, no significant fiscal implication to local government is anticipated.
