No significant fiscal implication to the State is anticipated.


The bill would require the Department of Aging and Disability Services (DADS) to accept an accreditation survey from the Commission on Accreditation of Rehabilitation Facilities (CARF) or the Joint Commission on Accreditation of Healthcare Organizations (JCAHO) to satisfy assisted living licensure renewal or certification requirements instead of an annual licensing inspection.

The bill would also require DADS to determine whether a waiver of authorization from a federal agency is necessary under federal law, including for federal funding purposes, before the agency could accept an accreditation for an assisted living facility instead of an inspection for purposes of licensure renewal. The bill requires the determination to be accomplished no later than October 1, 2005.

According to DADS, implementation of this bill may require automation system changes; however, it is assumed that the cost of the changes could be absorbed within existing resources.
