LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 79TH LEGISLATIVE REGULAR SESSION

April 14, 2005

TO:
Honorable Jane Nelson, Chair, Senate Committee on Health & Human Services

FROM:
John S. O'Brien, Deputy Director, Legislative Budget Board

IN RE:
SB1055 by Janek (Relating to an alternative method of satisfying certain licensing and program participation requirements for assisted living facilities. ), Committee Report 1st House, Substituted

No significant fiscal implication to the State is anticipated.

The bill would require the Department of Aging and disability Services (DADS) to accept an accreditation survey from the Commission on Accreditation of Rehabilitation Facilities (CARF) or the Joint Commission on Accreditation of the Healthcare Organizations (JCAHO) to satisfy assisted living licensure or certification requirements instead of an annual licensing inspection.

According to DADS, implementation of this bill may require automation system changes; however, it is assumed that the cost of the changes could be absorbed within existing resources.

Local Government Impact

No fiscal implication to units of local government is anticipated.
