The bill would authorize a political subdivision to require a person who performs or proposes to perform consent or nonconsent tows to obtain a license or permit for operating a tow truck. The bill would take effect immediately if it receives the required two-thirds vote in each house; otherwise, it would take effect September 1, 2005.
Under current statute, a political subdivision is prohibited from requiring a person who performs nonconsent tows from obtaining a license or permit to operate a tow truck. A fee charged for a license or permit may not exceed $15.
