No fiscal implication to the State is anticipated.
The bill would amend Subchapter B, Chapter 242, Health and Safety Code by adding Section 242.0425. The new section requires licensed nursing facilities to provide each resident and their next of kin or guardian a written statement informing them of whether the facility is covered by professional health care liability insurance. The resident or their next of kin or guardian must sign the statement and the facility must maintain a copy of the signed statement in the facility records maintained for the resident.
The bill would require the Department of Aging and Disability Services to develop a form, not later than December 1, 2005, for the nursing facilities to use in informing residents and their next of kin or guardian on whether the facility has professional health care liability insurance.
