Austin, Texas

FISCAL NOTE, 79TH LEGISLATIVE REGULAR SESSION

May 12, 2005

TO:
Honorable Will Hartnett, Chair, House Committee on Judiciary

FROM:
John S. O'Brien, Deputy Director, Legislative Budget Board

IN RE:
SB1147 by Harris (Relating to the appointment of visiting associate judges.), As Engrossed

No significant fiscal implication to the State is anticipated.

The bill would amend the Family Code to provide that Section 2252.901 of the Government Code does not apply to a visiting associate judge appointed under Subchapter B or C of the Family Code.  Section 2252.90, Government Code, prohibits a state agency from hiring a former employee for a one year period following the employees last date of employment with the agency.  The provison would allow the presiding judges to appoint retired or former child protection and child support associate judges to sit as visiting associate judges for the child protection and child support courts regardless of when they were last employed by the Office of Court Administration.

Local Government Impact

No significant fiscal implication to units of local government is anticipated.
