No significant fiscal implication to the State is anticipated.

This bill would amend the Insurance Code as it relates to the regulation of electronic transmissions of health benefit information between a health care insurer and a physician or health care provider. 

The Health and Human Services Commission indicates that they will not experience a significant fiscal impact.  However, the agency will incur costs for the Children's Health Insurance Program (CHIP) contractors to add functionality, hardware, and software to collect and store the data specified in Section 847.002, and to provide real-time availability of eligibility information that reflects current system data.

Based on the analysis of the Department of Insurance, it is assumed that any additional work resulting from the passage of the bill could be reasonably absorbed within current resources.

The bill would take effect immediately upon receiving a two-thirds majority vote in each house.  If the bill does not receive a two-thirds vote in each house, the bill would take effect September 1, 2005.


Local Government Impact

No fiscal implication to units of local government is anticipated.
