The bill would amend the Government Code to allow the Commission on Jail Standards to collect a fee to cover the cost of performing any reinspection of a municipal or county jail that has been found to not be in compliance with minimum standards and that requests the reinspection before taking action to ensure the jail is in compliance. The fee is to be deposited in a special account in the General Revenue Fund to be appropriated only to pay costs incurred by the commission. The bill would take effect September 1, 2005.
The bill would create or recreate a dedicated account in the General Revenue Fund, create or recreate a special or trust fund either within or outside of the Treasury, or create a dedicated revenue source. Therefore, the fund, account, or revenue dedication included in this bill would be subject to funds consolidation review by the current Legislature.
The Commission on Jail Standards estimates that the revenue collected under the provisions of the bill would be approximately $5,000 per fiscal year.
