LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 79TH LEGISLATIVE REGULAR SESSION

March 22, 2005

TO:
Honorable Frank Madla, Chair, Senate Committee on Intergovernmental Relations

FROM:
John S. O'Brien, Deputy Director, Legislative Budget Board

IN RE:
SB1296 by Deuell (Relating to the regulatory authority of certain counties in certain unincorporated areas of the counties; providing a penalty.), As Introduced

No fiscal implication to the State is anticipated.

The bill would authorize a county that has a population of less than 100,000 and that had a percentage change in its population growth, according to the two most recent federal decennial censuses, of less than 50 percent and that is located adjacent to a county in which three or more municipalities, each with a population of more than 175,000, are predominantly located to regulate land use in unincorporated areas of the county. The criteria would apply only to Kaufman County.

Local Government Impact

Because the bill would not have statewide impact on units of local government of the same type or class, no comment from this office is required by the rules of the House/Senate as to its probable fiscal implication on units of local government.
