LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 79TH LEGISLATIVE REGULAR SESSION

April 6, 2005

TO:
Honorable Jane Nelson, Chair, Senate Committee on Health & Human Services

FROM:
John S. O'Brien, Deputy Director, Legislative Budget Board

IN RE:
SB1378 by Staples (Relating to the certification of certain nonprofit hospitals and hospital systems for limited liability. ), Committee Report 1st House, Substituted

No significant fiscal implication to the State is anticipated.

The bill would amend the Health and Safety Code regarding requirements that nonprofit hospitals and nonprofit hospital systems must meet to be eligible for certification for limited liability and regarding the procedures and time frames with which the Department of State Health Services must comply when processing certification requests. The bill would take effect immediately if it receives the required two-thirds vote in each house; otherwise, it would take effect September 1, 2005. The bill would apply only to a certification that occurs on or after the effective date.

The Department of State Health Services indicates that any fiscal impact that may result from implementing the changes in procedures could be absorbed using existing resources.

Local Government Impact

No significant fiscal implication to units of local government is anticipated.
