No fiscal implication to the State is anticipated.

The bill would establish that an agreement between the Texas Department of Transportation (TxDOT) and a Regional Tollway Authority (RTA) to improve a portion of the state highway system would be governed by statutes and rules governing RTAs. The bill would also authorize TxDOT and an RTA to reach agreement on the design, development, and financing of independent or joint projects, and for the agreement to be governed by the statutes and rules governing RTAs. Provisions of the bill would repeal authorization for TxDOT to reach similar agreements with private entities.

The bill would revise public notice requirements for RTA rulemaking procedures and would determine more broadly that RTA agreements with a Regional Mobility Authority, TxDOT, the Texas Transportation Commission, or another governmental entity would be governed by statutes and rules governing RTAs.

Based on the analysis of the Texas Department of Transportation, the provisions of the bill would have no fiscal impact to the state.

The bill would take effect September 1, 2005.
