May 20, 2005

TO:
Honorable David Dewhurst, Lieutenant Governor, Senate

FROM:
John S. O'Brien, Deputy Director, Legislative Budget Board

IN RE:
SB1421 by Gallegos (Relating to eligibility for beginning positions in certain police and fire departments. ), As Passed 2nd House

No fiscal implication to the State is anticipated.

The bill would require certain civil service commissions to promulgate rules to identify and verify each applicant's eligiblity to be ranked at the top of any eligibility list for an entry position with the fire or police department for which the applicant passes the entrance exam and meets the other requirements if the applicant is a natural-born or adopted child of a firefighter who was killed in the line of duty under Chapter 143, Local Government Code.

The bill would amend Section 143.023(c), Local Government Code, to remove the prohibition against allowing a person between the ages of 36 and 45 from being certified as eligible for a beginning position in a police department unless the person has at least five years' experience as a peace officer or of military experience.

Local Government Impact
