May 19, 2005

TO:
Honorable Harvey Hilderbran, Chair, House Committee on Culture, Recreation, & Tourism

FROM:
John S. O'Brien, Deputy Director, Legislative Budget Board

IN RE:
SB1455 by Wentworth (Relating to the establishment of regional habitat conservation plans by political subdivisions of this state.), As Engrossed

No significant fiscal implication to the State is anticipated.

The bill would amend the Parks and Wildlife Code to make adjustments to requirements and procedures a political subdivision must follow for the establishment of regional habitat conservation plans and for acceptance of federal permits in conjunction with implementing those plans. The bill would also reduce the requirements placed on the state Parks and Wildlife Commission regarding actions after approving a grievance related to a regional plan.

The bill would take effect immediately if it receives the required two-thirds vote in each house; otherwise, it would take effect September 1, 2005. Provisions of the bill would apply only to applicable actions on or after the effective date.

Local Government Impact

No significant fiscal implication to units of local government is anticipated.
