No fiscal implication to the State is anticipated.

The bill would add a second Section 49.466 to the Water Code to prohibit areas defined in the bill that are within certain districts from being included within the boundaries of another political subdivision without consent of the district. The bill would take effect immediately if it receives the required two-thirds vote in each house; otherwise, it would take effect September 1, 2005.

The existing Section 49.466, Water Code, addresses rules that the Texas Commission on Environmental Quality must establish for the provision and financing of recreational facilities funded through the issuance of bonds that are supported by ad valorem taxes.


Local Government Impact

It is assumed that for another political subdivision to obtain consent from a district to include an area of the district within the boundaries of that other political subdivision would require either administrative actions that would not have a significant fiscal impact or an election within the district. Based on data submitted by various local government entities in March 2004 to the Secretary of State, the average cost per registered voter for an election is $1.29.
