No fiscal implication to the State is anticipated.

The bill would amend the Health and Safety Code as it relates to procedures for selecting emergency services district commissioners, including requiring an election in single-county districts. The bill would take effect September 1, 2005. In a single-county district, the county judge would be required to establish the election in calendar year 2006 to replace commissioners appointed before the effective data and again in 2007 to replace remaining appointed commissioners.

Under current statute, the commissioners are elected in an emergency services district located in more than one county and they are appointed by the commissioners court in a district located wholly in one county. The change in statute would require that the district commissioners be elected, regardless of the district existing in a single county or multiple counties. Under the proposed statute, however, an election in a single-county district would be required to be held on the same date as the county's precinct elections.
