The bill would amend the Health and Safety Code to specify that a municipal hospital authority management contractor in its management or operation of a hospital under a contract with a municipal hospital authority and a county hospital authority in its management or operation of a hospital under a contract with a county hospital authority are considered to be governmental units for purposes of Chapters 101, 102, and 108, Civil Practice and Remedies Code. Those chapters cover tort claims, tort claims payments by local governments, and limitations of liability for public servants. Employees of the contractors would be considered employees of the hospital authorities and also covered by Chapters 101, 102, and 108.
The bill would take effect September 1, 2005 and would apply only to an action filed on or after that date.
