No significant fiscal implication to the State is anticipated.

The bill would authorize counties, upon written notice to the Texas Department of Transportation (TxDOT), to prohibit a person from erecting an off-premise sign adjacent to and visible from a road that lies outside the corporate and extraterritorial limits of a municipality. The bill would not make an allowance for TxDOT to relocate an off-premise sign to accommodate a highway construction project, and could require TxDOT to acquire some billboards instead of relocating them if there is not a suitable location outside a county's ban.

Based on the analysis of TxDOT, it is assumed that duties and responsibilities associated with the implementation of the bill could be covered by using existing resources.

The bill would take effect September 1, 2005.
