No fiscal implication to the State is anticipated.
The bill would authorize a county clerk who believes in good faith that a document or instrument that purports to create a lien and is offered or submitted for filing is fraudulent to request assistance from the county attorney to determine before filing or recording if the document is fraudulent or not. The bill would take effect September 1, 2005.
