No significant fiscal implication to the State is anticipated.

The bill would amend the Transportation Code to allow the Texas Department of Transportation (TxDOT) to purchase fee title, an easement, a leasehold, or any other interest in real property that has been identified for possible use in connection with a transportation facility before a final decision has been made as to whether the facility will be located on that property.

Based on the analysis of TxDOT, it is assumed any duties associated with implementing the provisions of the bill could be absorbed within existing resources.

The bill would take effect immediately upon receiving a vote of two-thirds of all members elected to each house or otherwise on September 1, 2005.
