LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 79TH LEGISLATIVE REGULAR SESSION

May 26, 2005

TO:
Honorable David Dewhurst, Lieutenant Governor, Senate

FROM:
John S. O'Brien, Deputy Director, Legislative Budget Board

IN RE:
SB1710 by Staples (Relating to outdoor burning under the Texas Clean Air Act.), As Passed 2nd House

No significant fiscal implication to the State is anticipated.

The bill would require the Commission on Environmental Quality (TCEQ) to authorize by rule outdoor burning of trees, brush, grass, leaves, branch trimmings, or other plant growth if the burning occurs in an area that is in attainment with National Ambient Air Quality Standards and is burned on the property where it was generated by the owner of the property. It would also prohibit the TCEQ from controlling or prohibiting burning of such wastes in certain areas if fire protection personnel would supervise the burning. Passage of the bill is not expected to result in a significant increase in TCEQ workload.

Local Government Impact

No significant fiscal implication to units of local government is anticipated.
