LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 79TH LEGISLATIVE REGULAR SESSION

April 7, 2005

TO:
Honorable Kenneth Armbrister, Chair, Senate Committee on Natural Resources

FROM:
John S. O'Brien, Deputy Director, Legislative Budget Board

IN RE:
SB1710 by Staples (Relating to outdoor burning under the Texas Clean Air Act.), As Introduced

No significant fiscal implication to the State is anticipated.

The bill would require the Commission on Environmental Quality (TCEQ) to authorize by rule outdoor burning of trees, brush, grass, leaves, branch trimmings, or other plant growth if the burning occurs in an area that is in attainment with National Ambient Air Quality Standards and is burned on the property where it was generated by the owner of the property.  Passage of the bill is not expected to result in a significant increase in TCEQ workload.

Local Government Impact

No significant fiscal implication to units of local government is anticipated.
