No significant fiscal implication to the State is anticipated.

The bill would allow a person who submits an application for certain permits to modify an existing facility to begin construction after the application is submitted and before the Texas Commission on Environmental Quality (TCEQ) has issued the permit. It would also require that if a standard permit for a facility requires a distance, setback, or buffer from other property or structures as a condition of the permit, the determination of whether such requirements are satisfied would be made based on conditions at the earlier of the date of new construction, expansion or modification of a facility begins or the date an application or notice of intent was first filed with the TCEQ.

No significant fiscal implications to the TCEQ are expected.
