No significant fiscal implication to the State is anticipated.

The bill would amend Chapter 60 of the Water Code to authorize a navigation district or port authority to purchase items from the United States, a U.S. agency, the State of Texas, or a Texas state agency, notwithstanding other purchasing requirements contained in Chapter 60.

Under the provisions of the bill, a navigation district that adopts a safety or security code, policy, or manual could not be sued for noncompliance of those items. A navigation district created under Article XVI, Section 59, Texas Constitution would be authorized to enter into a contract with any person, including a municipality or other political subdivision in a county adjacent to the district, to accomplish any district purpose or exercise any district power. Under such contract, the district could issue obligations and use the proceeds to provide a project located in a county adjacent to the district that serves to accomplish a district purpose.

The bill would take effect September 1, 2005.
