LEGISLATIVE BUDGET BOARD
Austin, Texas

CRIMINAL JUSTICE IMPACT STATEMENT

79TH LEGISLATIVE REGULAR SESSION

April 11, 2005

TO:
Honorable Terry Keel, Chair, House Committee on Criminal Jurisprudence

FROM:
John S. O'Brien, Deputy Director, Legislative Budget Board

IN RE:
HB83 by Riddle (Relating to the eligibility of certain criminal defendants for release on community supervision.), As Introduced

The bill would amend the Code of Criminal Procedure by treating a juvenile court felony adjudication that resulted in a youth’s commitment to the Texas Youth Commission in the same manner as an adult criminal court felony conviction for purposes of making a person ineligible for jury recommended community supervision.  An increase in the adult incarceration population may result from offenders who might otherwise have been eligible for jury recommended community supervision; however, the increase in population is not anticipated to be significant.
