LEGISLATIVE BUDGET BOARD
Austin, Texas

CRIMINAL JUSTICE IMPACT STATEMENT

79TH LEGISLATIVE REGULAR SESSION

March 24, 2005

TO:
Honorable Ray Allen, Chair, House Committee on County Affairs

FROM:
John S. O'Brien, Deputy Director, Legislative Budget Board

IN RE:
HB549 by Phillips (Relating to prohibiting the introduction of certain items in certain local jails. ), Committee Report 1st House, Substituted

The bill would amend the Penal Code by prohibiting certain items to a person confined in a local jail.  Providing any of the listed contraband would be punishable as a felony of the third degree.  A third degree felony is punishable by imprisonment in the institutional division for any term of not more than 10 years or less than 2 years, or in addition to confinement, a fine not to exceed $10,000.

The impact of the bill would depend on the number of persons caught and convicted of the offense; however, in the case of this bill, the increased workload and demand for resources would probably not be substantial.
