The bill would amend the Code of Criminal Procedure by prohibiting certain persons from residing near a school. A person would commit a felony of the third degree if a person who is required to register as a sex offender because of a reportable conviction or adjudication involving a victim younger than 14 years of age or a person who is civilly committed as a sexually violent predator and subject to outpatient treatment and supervision resides within 1,000 feet of a public or private school campus. The change in law would not apply to a person who resided at the residence on September 1, 2005 or a person residing at a residence at the time that a campus is established or extended to within 1,000 feet of the residence.
A third degree felony is punishable by imprisonment in the institutional division for any term of not more than 10 years or less than 2 years, or in addition to confinement, a fine not to exceed $10,000.
The impact of the bill would depend on the number of persons caught and convicted of the offense; however, in the case of this bill, the increased workload and demand for resources would probably not be substantial.
