HB1474 by Eiland (Relating to certain information contained in records about members, retirees, annuitants, or beneficiaries of the Texas County and District Retirement System.), As Engrossed

As a result of this bill there will be a restriction upon:

(1) the open records law.

The bill would amend the Government Code to except certain information relating to the Texas County and District Retirement System from the disclosure requirements of the Public Information Act.  The bill excepts from mandatory disclosure certain information maintained in the custody of a governmental entity other than the retirement system, or an administrator acting in cooperation with or on behalf of the retirement system. Although Government Code Section 815.503 applies this standard to the Employees Retirement System of Texas, the bill would be an expansion of the existing disclosure exception for the Texas County and District Retirement System, and would have an impact on open records laws.
