LEGISLATIVE BUDGET BOARD
Austin, Texas

OPEN GOVERNMENT IMPACT STATEMENT

79TH LEGISLATIVE REGULAR SESSION

May 9, 2005

TO:
Honorable Robert Duncan, Chair, Senate Committee on State Affairs

FROM:
John S. O'Brien, Deputy Director, Legislative Budget Board

IN RE:
HB2191 by Wong (Relating to the treatment of social security numbers under the public information law.), As Engrossed

As a result of this bill there will be a restriction upon:

(1) the open records law.

The bill would amend the Government Code to except the social security number of a living person from the disclosure requirements of the Public Information Act.  The bill allows governmental bodies to redact such information from disclosed records without the necessity of an attorney general opinion.  The bill would take effect immediately if receiving a vote of two-thirds of all members in each house, or September 1, 2005.  Because the bill would create an exception to the disclosure requirements of the Public Information Act, an impact to open government laws is anticipated.
