LEGISLATIVE BUDGET BOARD
Austin, Texas

CRIMINAL JUSTICE IMPACT STATEMENT

79TH LEGISLATIVE REGULAR SESSION

May 3, 2005

TO:
Honorable Mike Krusee, Chair, House Committee on Transportation

FROM:
John S. O'Brien, Deputy Director, Legislative Budget Board

IN RE:
HB2893 by Phillips (Relating to a motor vehicle liability insurance compliance program; providing civil and criminal penalties.), Committee Report 1st House, Substituted

The provision of the bill that is the subject of this analysis would create a state jail felony offense for disclosing information to someone who is not authorized to receive, view, read, or copy information from the motor vehicle liability insurance program database maintained by the Texas Department of Public Safety (DPS) or other administering entity.

A state jail felony is punishable by confinement in a state jail for any term of not more than two years or less than 180 days, or in addition to confinement, a fine not to exceed $10,000.

The impact of the bill would depend on the number of persons caught and convicted of the offense; however, in the case of this bill, the increased workload and demand for resources would probably not be substantial.
