LEGISLATIVE BUDGET BOARD
Austin, Texas

CRIMINAL JUSTICE IMPACT STATEMENT

79TH LEGISLATIVE REGULAR SESSION

April 19, 2005

TO:
Honorable Terry Keel, Chair, House Committee on Criminal Jurisprudence

FROM:
John S. O'Brien, Deputy Director, Legislative Budget Board

IN RE:
HB2929 by Smith, Todd (Relating to the payment of fines, court costs, and restitution imposed on a defendant in a criminal case.), As Introduced

The bill would amend the Code of Criminal Procedure by authorizing a judge, and, in certain instances, to require a judge to extend community supervision of a defendant who has failed to pay a previously assessed fine, costs, or restitution if the judge determines the extension would increase the likelihood the defendant would fully pay what is owed.  A judge would be prohibited from reducing or terminating the period of community supervision early if the defendant has not paid previously assessed fines, costs, or restitution.

The impact of the bill could increase the community supervision population, depending on the number of offenders that would have their terms extended due to the provisions of the bill.  It is assumed that the increase in the population resulting from this bill would not result in a significant impact on the programs and workload of state corrections agencies.
