WATER DEVELOPMENT POLICY IMPACT STATEMENT

HB3526 by Hochberg (Relating to the creation of the Greater Sharpstown Management District; providing authority to impose a tax and issue a bond or similar obligation.), Committee Report 2nd House, Substituted

The Legislative Budget Board in cooperation with the Water Development Board (TWDB) and Texas Commission on Environmental Quality (TCEQ), has determined the following:

 

The bill would create the Greater Sharpstown Management District in Harris County with the powers and duties of a Management District under Sections 52 and 52-a, Article III, and Section 59, Article XVI, Texas Constitution, and other powers granted under this chapter.

 

1) Population- The City of Houston population projection for use in the 2006 State Water Plan shows an increase from 1,953,631 to 2,240,974, a 15 percent increase.

 

2) Location & Size- The District includes unstated acres within Harris County. The proposed district would be located in west Houston; an area around the intersection of Gessner Drive and Westpark Tollway.

 

3) Powers- The District may authorize the creation of a nonprofit corporation to assist and act for the district in implementing a project or providing a service.

 

4) District Finances.- The District must receive approval from the City of Houston to issue bonds. District is subject to property tax assessment and ad valorem tax.

 

5) Board of Directors- The District is to be governed by a board of 9 voting directors who serve staggered terms of four years. The directors are appointed by the mayor and members of the governing body of the City of Houston. There are nonvoting directors from the parks and recreation, planning and development, public works, civic center and the City of Houston’s chief of police.

 

6) Eminent Domain- There is no power of eminent domain.

 

7) Ability to Tax- Yes, for bonds subject to City of Houston approval and ad valorem tax subject to voter approval.

 

8) Ability to Exclude Property- Data not available.

 

9) Overlapping Services- From the boundary description provided for the proposed district, there is not enough information to determine if overlaps exist.

 

10) Adequacy of Boundary Description- There is not enough information to check for closure.

 

11) Comments on Powers /Duties Different from Similar Types of Districts- The district may exercise the powers given to a corporation under Section 4B, Development Corporation Act of 1979 (Article 5190.6, Vernon's Texas Civil Statutes), including the power to own, operate, acquire, construct, lease, improve, or maintain projects described by that section.

 

12) TCEQ’s Supervision- The District is exempt from TCEQ auditing and bond review authority unless the bonds are issued specifically for water, wastewater, or drainage facilities.

 

13) State Water Plan Objectives-Water Use: It is assumed that the creation of this district would have no impact on the State Water Plan objectives.
