LEGISLATIVE BUDGET BOARD
Austin, Texas

OPEN GOVERNMENT IMPACT STATEMENT

79TH LEGISLATIVE REGULAR SESSION

April 25, 2005

TO:
Honorable Robert Duncan, Chair, Senate Committee on State Affairs

FROM:
John S. O'Brien, Deputy Director, Legislative Budget Board

IN RE:
SB121 by Duncan (Relating to a requestor's right of access to investment information. ), Committee Report 1st House, Substituted

As a result of this bill there will be a restriction upon:

(1) the open records law; and
(2) the access to government information.

The bill would amend the Government Code to create a new exception to the Public Information Act.  Certain investment and securities information not expressly listed in the bill as subject to mandatory disclosure would be confidential and excepted from mandatory disclosure.  Because the bill creates a new exception to the Public Information Act, an impact upon open government laws is expected.
