SB130 by Nelson (Relating to the provision of health and human services in this state.), As Introduced

As a result of this bill there will be no significant restriction upon:

(1) the open records law;
(2) the open meetings law;
(3) the access to government information; or
(4) the ability of the citizens of Texas to transact public business.

The bill would make numerous changes to the Government Code affecting the Health and Human Services Commission.  The bill would take effect immediately if receiving a vote of two-thirds of all members elected in each house, or September 1, 2005.

Section Two of the bill is the only portion that would have a potential open government impact.  Existing Government Code 531.1021(g) provides an exception to the Public Information Act for certain information and materials related to an investigation by the Inspector General's Office at the Health and Human Services Commission.  Section Two adds Government Code 531.1021(h), which expressly excepts information and materials related to resolved cases from Government Code 531.1021(g).  Because the bill would only potentially increase the public's access to information, no significant restriction upon open government laws is anticipated.
