LEGISLATIVE BUDGET BOARD
Austin, Texas

OPEN GOVERNMENT IMPACT STATEMENT

79TH LEGISLATIVE REGULAR SESSION

February 27, 2005

TO:
Honorable Jane Nelson, Chair, Senate Committee on Health & Human Services

FROM:
John S. O'Brien, Deputy Director, Legislative Budget Board

IN RE:
SB239 by Janek (Relating to an exemption from the fee for a birth or death record requested by a law enforcement agency, a child fatality review team, or the child fatality review team committee.), As Introduced

As a result of this bill there will be no significant restriction upon:

(1) the open records law;
(2) the open meetings law;
(3) the access to government information; or
(4) the ability of the citizens of Texas to transact public business.

The bill would exempt law enforcement agencies and child fatality review teams and committees from fee payment for copies of birth or death certificates from state or local registrar offices.  The bill would take effect immediately if receiving a two-thirds vote of each house, or September 1, 2005.  Because the bill would not affect public access to governmental information, the bill would have no impact on open government laws.
