LEGISLATIVE BUDGET BOARD
Austin, Texas

OPEN GOVERNMENT IMPACT STATEMENT

79TH LEGISLATIVE REGULAR SESSION

March 4, 2005

TO:
Honorable Frank Madla, Chair, Senate Committee on Intergovernmental Relations

FROM:
John S. O'Brien, Deputy Director, Legislative Budget Board

IN RE:
SB541 by Seliger (Relating to the confidentiality of photographs of certain residential property held by an appraisal district.), As Introduced

As a result of this bill there will be a restriction upon:

(1) the open records law; and
(2) the access to government information.

The bill would make photographic records of non-homestead residential properties held by appraisal districts confidential and available only for the official use of the appraisal district, the state,  the comptroller, and taxing units and political subdivisions.  The bill would take effect September 1, 2005.  Because the bill would restrict public access to government records and information, there would be an impact on open government laws.
