LEGISLATIVE BUDGET BOARD
Austin, Texas

OPEN GOVERNMENT IMPACT STATEMENT

79TH LEGISLATIVE REGULAR SESSION

March 28, 2005

TO:
Honorable Robert Duncan, Chair, Senate Committee on State Affairs

FROM:
John S. O'Brien, Deputy Director, Legislative Budget Board

IN RE:
SB690 by Zaffirini (Relating to the required posting by a governmental body of a meeting of the governmental body that is continued to the following regular business day.), As Introduced

As a result of this bill there will be a restriction upon:

(1) the open meetings law.

The bill would amend the Government Code to create exceptions from the posting requirements of the Open Meetings Act.  The bill would allow governmental bodies to recess a meeting to the next regular business day without posting notice if the action is taken in good faith and not to circumvent the Open Meetings Act.  If a catastrophe prevents the governmental body from convening the continued meeting the next regular business day, the bill would allow the governmental body to convene the continued meeting on the following regular business day without posting the notice required under the Open Meetings Act.  Because the bill would create exceptions to the posting requirements of the Open Meetings Act, the bill would have an impact on open government laws.
