LEGISLATIVE BUDGET BOARD
Austin, Texas

OPEN GOVERNMENT IMPACT STATEMENT

79TH LEGISLATIVE REGULAR SESSION

May 2, 2005

TO:
Honorable Robert Duncan, Chair, Senate Committee on State Affairs

FROM:
John S. O'Brien, Deputy Director, Legislative Budget Board

IN RE:
SB727 by Wentworth (Relating to the public information law.), Committee Report 1st House, Substituted

As a result of this bill there will be no significant restriction upon:

(1) the open records law;
(2) the open meetings law;
(3) the access to government information; or
(4) the ability of the citizens of Texas to transact public business.

The bill would amend the Government Code to make numerous changes to the Public Information Act.  The bill transfers responsibilities under the Act from the General Services Commission (currently the Texas Building and Procurement Commission) to the Office of the Attorney General.

The bill would consider a disclosure request withdrawn if the requestor does not respond in writing within thirty days of receiving written notice that the initial request would require programming or manipulation of data.  The bill would also require parties submitting comments, briefs, or letters to the attorney general regarding an open records opinion to copy the other parties involved in the disclosure dispute.  No significant restriction of open government laws is anticipated as a result of the bill.
