79TH LEGISLATIVE REGULAR SESSION

April 14, 2005

TO:
Honorable Jane Nelson, Chair, Senate Committee on Health & Human Services

FROM:
John S. O'Brien, Deputy Director, Legislative Budget Board

IN RE:
SB1113 by Gallegos (Relating to allowing a hospital to release protected health information of a patient to emergency medical services providers for treatment, payment, and health care operations. ), Committee Report 1st House, Substituted

As a result of this bill there will be no significant restriction upon:

(1) the open records law;
(2) the open meetings law;
(3) the access to government information; or
(4) the ability of the citizens of Texas to transact public business.

The bill would amend the Health and Safety Code to add to the list of circumstances under which health care information may be disclosed to emergency medical services providers without patient authorization.  The bill is not expected to have any significant restriction on open government laws.
