LEGISLATIVE BUDGET BOARD
Austin, Texas

OPEN GOVERNMENT IMPACT STATEMENT

79TH LEGISLATIVE REGULAR SESSION

April 19, 2005

TO:
Honorable Robert Duncan, Chair, Senate Committee on State Affairs

FROM:
John S. O'Brien, Deputy Director, Legislative Budget Board

IN RE:
SB1133 by Hinojosa (Relating to posting notice online of the meetings of certain governmental bodies.), Committee Report 1st House, Substituted

As a result of this bill there will be no significant restriction upon:

(1) the open records law;
(2) the open meetings law;
(3) the access to government information; or
(4) the ability of the citizens of Texas to transact public business.

The bill would amend the Government Code to require certain governmental bodies or economic development corporations to post notice of meetings on their websites, in addition to the existing posting requirements in the Open Meetings Act.  The bill would take effect January 1, 2006.  Because the bill would potentially expand the public's access to government information, there is no restriction of open government laws expected.
