LEGISLATIVE BUDGET BOARD
Austin, Texas

OPEN GOVERNMENT IMPACT STATEMENT

79TH LEGISLATIVE REGULAR SESSION

April 26, 2005

TO:
Honorable Frank Madla, Chair, Senate Committee on Intergovernmental Relations

FROM:
John S. O'Brien, Deputy Director, Legislative Budget Board

IN RE:
SB1136 by Seliger (Relating to the method of selecting public members to serve on a county's salary grievance committee.), As Introduced

As a result of this bill there will be a restriction upon:

(1) the open records law;
(2) the access to government information; and
(3) the ability of the citizens of Texas to transact public business.

The bill would amend the Local Government Code to change the procedure for disclosure of the names of the public members of a county's salary grievance committee.  Current law requires the names of public members to be announced at the commissioner's court meeting at which they are selected.  The bill would prohibit disclosure of the names of the public members of the salary grievance committee until the first public hearing of the grievance committee.  Because the bill would create an exception to the disclosure requirements of the Public Information Act, an impact to open government laws is expected.
