LEGISLATIVE BUDGET BOARD
Austin, Texas

OPEN GOVERNMENT IMPACT STATEMENT

79TH LEGISLATIVE REGULAR SESSION

March 28, 2005

TO:
Honorable Robert Duncan, Chair, Senate Committee on State Affairs

FROM:
John S. O'Brien, Deputy Director, Legislative Budget Board

IN RE:
SB1485 by Williams (Relating to providing that the social security number of a living person is excepted from required disclosure under the public information law and may be redacted without the necessity of requesting a decision from the attorney general.), As Introduced

As a result of this bill there will be a restriction upon:

(1) the open records law; and
(2) the access to government information.

The bill would except the social security number of a living person from the requirements of Government Code Section 552.021 and allow a governmental body to redact the social security number of a living person from disclosed information without seeking an attorney general decision.  The bill would take effect immediately if receiving a vote of two-thirds of all members in each House, or September 1, 2005.  Because the bill would create an exception to the Public Information Act, the bill would result in a restriction upon the open records law and public access to government information.
