LEGISLATIVE BUDGET BOARD
Austin, Texas

CRIMINAL JUSTICE IMPACT STATEMENT

79TH LEGISLATIVE REGULAR SESSION

April 5, 2005

TO:
Honorable Robert Duncan, Chair, Senate Committee on State Affairs

FROM:
John S. O'Brien, Deputy Director, Legislative Budget Board

IN RE:
SB1493 by Williams (Relating to the laws administered by the Texas Ethics Commission for the fair conduct of elections and election campaigns; providing penalties.), As Introduced

The provision of the bill that is the subject of this analysis would amend the Election Code by making the use of coercive behavior to obtain contributions, or the acceptance of contributions coercively gained, punishable as a felony of the third degree.

A third degree felony is punishable by imprisonment in the institutional division for any term of not more than 10 years or less than 2 years, or, in addition to confinement, a fine not to exceed $10,000.

The impact of this provision of the bill would depend on the number of persons caught and convicted of the offense; however, in the case of this bill, the increased workload and demand for resources would probably not be substantial.
