LEGISLATIVE BUDGET BOARD
Austin, Texas

OPEN GOVERNMENT IMPACT STATEMENT

79TH LEGISLATIVE REGULAR SESSION

April 14, 2005

TO:
Honorable Steve Ogden, Chair, Senate Committee on Finance

FROM:
John S. O'Brien, Deputy Director, Legislative Budget Board

IN RE:
SB1617 by Ogden (Relating to the powers, duties, and functions of the Legislative Budget Board.), As Introduced

As a result of this bill there will be a restriction upon:

(1) the open records law; and
(2) the access to government information.

The bill would make numerous statutory changes relating to the Legislative Budget Board's powers, duties, and functions.  The bill would add Section 322.019 to the Government Code, which would make certain communications between members of the legislature or the lieutenant governor and an assistant or employee of the Legislative Budget Board confidential.  Because the bill would create an exception to the Public Information Act,  a restriction upon the open records law and the public's access to government information is anticipated.
