Pursuant to a notice posted on February 2, 2005, and a
suspension of all necessary rules to allow the Committee to meet
while the House is in session on February 3, 2005, the House
Committee on Election Contests, Select, met in a public hearing
and was called to order by the chair, Representative Keel, at
9:36 a.m.
The roll was answered as follows:
Present: Representatives Keel; Eiland; Denny; Giddings;
Guillen; Hupp; King, Phil; Phillips; Ritter (9).
Absent: None (0).
A quorum was present.
At 9:37 a.m., on the motion of the chair and without objection,
the meeting was recessed subject to the call of the chair so
that the Committee could go into executive session, Pursuant to
Rule 4, Section 12, to discuss the imposition of costs in the
District 149 election contest.
The committee reconvened at 9:49 a.m. and was called to order by
the chair, Representative Keel. The roll was answered as
follows:
Present: Representatives Keel; Eiland; Denny; Giddings;
Guillen; Hupp; King, Phil; Phillips; Ritter (9).
Absent: None (0).
A quorum was present.
Representative Eiland moved that the Committee adopt a
recommendation that no costs be assessed against the Contestant.
The motion prevailed by the following record vote:
Ayes: Representatives Keel; Eiland; Denny; Giddings;
Guillen; Hupp; King, Phil; Phillips; Ritter (9).
Nays: None (0).
Present,Not Voting: None (0).
Representative Eiland moved that the Committee recommendation
that no costs be assessed against the Contestant, as well as the
previous actions in the District 35 and District 50 race, be
printed in a single document and distributed to the full House
for its consideration. The motion prevailed by the following
record vote:
Ayes: Representatives Keel; Eiland; Denny; Giddings;
Guillen; Hupp; King, Phil; Phillips; Ritter (9).
Nays: None (0).
Present,Not Voting: None (0).
At 9:51 a.m., on the motion of Representative Guillen and
without objection, the meeting was adjourned subject to the call
of the chair.
