Pursuant to a notice posted in accordance with Senate Rule
11.18, a public hearing of the Senate Committee on Education was
held on Tuesday, March 22, 2005, in the Capitol Extension, Room
E1.028, at Austin, Texas.

The chair called the meeting to order at 8:35 a.m. The
following business was transacted:
The chair laid out SB 851 and recognized the author, Senator
Shapleigh, to explain the bill. Senator West sent up Committee
Amendment 1. Senator Shapleigh was recognized to explain the
amendment.
There being a quorum present at 8:39 a.m., the clerk called the
roll.
The chair resumed discussion on SB 851. Senator West moved
adoption of Committee Amendment 1; without objection, the
amendment was adopted. Witnesses testifying and registering on
the bill are shown on the attached list. The chair moved that
the public testimony be closed; without objection, it was so
ordered. Senator Averitt moved that SB 851, as amended, be
reported back to the Senate with the recommendation that it do
pass and be printed. The motion carried with a record vote of 7
ayes, 0 nay, 0 present not voting, and 2 absent.
The chair laid out SB 221 and recognized the author, Senator
Zaffirini, to explain the bill. Senator Zaffirini sent up a
committee substitute; the chair recognized Senator Zaffirini to
explain the difference between the committee substitute and the
bill as filed. The chair moved adoption of the committee
substitute; without objection, it was so ordered. Witnesses

Senator West. The chair moved that the subcommittee report be
adopted; there being no objection, it was so ordered. Senator

The chair announced that Senator Ogden requested unanimous
