Pursuant to a notice posted in accordance with Senate Rule
11.18, a public hearing of the Senate Committee on Education was
held on Monday, April 11, 2005, at Senator Shapiro's Desk, in
Austin, Texas.

The chair called the meeting to order at 3:50 p.m. There being
a quorum present, the following pending business from the April
7, 2005 hearing was considered:
At the request of the author, Senator Barrientos, SB 474 was
left pending as from the previous hearing on April 7, 2005.
The chair laid out SB 697 by Senator Estes. Senator Shapiro
briefly explained the bill. Senator Janek moved that SB 697 be
reported favorably to the Senate with the recommendation that it
do pass and be printed. The motion carried with a record vote
of 6 ayes, 0 nay, 0 present not voting, and 3 absent. Senator
Zaffirini moved that the bill be recommended for placement on
the Local & Uncontested Calendar; without objection, it was so
ordered.
The chair laid out SB 800 by Senator Lucio. Senator Shapiro
briefly explained the bill. The committee substitute was
previously sent up in the April 7, 2005 hearing. Senator
Shapiro explained the difference between the committee
substitute and the bill as filed. Senator Staples moved
adoption of the committee substitute; without objection, it was
so ordered. Senator Staples moved that SB 800 do not pass but
that CSSB 800 be reported back to the Senate with the
recommendation that it do pass and be printed. The motion
carried with a record vote of 8 ayes, 0 nay, 0 present not
voting, and 1 absent. Senator Janek moved that the bill be
recommended for placement on the Local & Uncontested Calendar;
without objection, it was so ordered.
At 3:54 p.m. Senator West assumed the chair.
The chair laid out SB 959 by Senator Shapiro. Senator Shapiro
briefly explained the bill. The committee substitute was
previously sent up in the April 7, 2005 hearing. Senator
Shapiro explained the difference between the committee

briefly explained the bill. Senator Averitt moved that SB 996 be
reported favorably to the Senate with the recommendation that it
do pass and be printed. The motion carried with a record vote
of 9 ayes, 0 nay, 0 present not voting, and 0 absent. Senator
Ogden moved that the bill be recommended for placement on the
Local & Uncontested Calendar; without objection, it was so
ordered.

briefly explained the bill. Senator Shapiro moved that SB 1146
be reported favorably to the Senate with the recommendation that
it do pass and be printed. The motion carried with a record
vote of 9 ayes, 0 nay, 0 present not voting, and 0 absent.
Senator Shapiro moved that the bill be recommended for placement
on the Local & Uncontested Calendar; without objection, it was

The chair laid out SB 1376 by Senator Staples. Senator Shapiro
briefly explained the bill. Committee Amendment No. 1 was sent
up previously at the April 7, 2005 hearing. Senator Staples
moved adoption of Committee Amendment No. 1; without objection,
the amendment was adopted. Senator Staples moved that SB 1376,
as amended, be reported back to the Senate with the
recommendation that it do pass and be printed. The motion
carried with a record vote of 9 ayes, 0 nay, 0 present not
voting, and 0 absent. Senator Averitt moved that the bill be
recommended for placement on the Local & Uncontested Calendar;
without objection, it was so ordered.
The subcommittee report on SB 114 by Senator Van de Putte was
laid out by Senator Shapiro. Senator Shapiro explained the
subcommittee report on SB 114. Senator Averitt then moved
adoption of the subcommittee report; there being no objection,
it was so ordered. Senator Averitt moved that SB 114 be
reported favorably to the Senate with the recommendation that it
do pass and be printed. The motion carried with a record vote
of 9 ayes, 0 nay, 0 present not voting, and 0 absent. Senator
Staples moved that the bill be recommended for placement on the
Local & Uncontested Calendar; without objection, it was so
ordered.
The subcommittee report on SB 302 by Senator Ellis was laid out
by Senator Shapiro. Senator Shapiro explained the subcommittee
report on CSSB 302. Senator Van de Putte then moved adoption of
the subcommittee report; there being no objection, it was so
ordered. Senator Van de Putte moved that SB 302 do not pass
but that CSSB 302 be reported back to the Senate with the
recommendation that it do pass and be printed. The motion
carried with a record vote of 9 ayes, 0 nay, 0 present not
voting, and 0 absent. Senator Averitt moved that the bill be
recommended for placement on the Local & Uncontested Calendar;
without objection, it was so ordered.
The subcommittee report on SB 528 by Senator Hinojosa was laid
out by Senator Shapiro. Senator Shapiro explained the
subcommittee report on CSSB 528. Senator Van de Putte then
moved adoption of the subcommittee report; there being no
objection, it was so ordered. Senator Van de Putte moved that
SB 528 do not pass but that CSSB 528 be reported back to the
Senate with the recommendation that it do pass and be printed.
The motion carried with a record vote of 9 ayes, 0 nay, 0
present not voting, and 0 absent. Senator Ogden moved that the
bill be recommended for placement on the Local & Uncontested
Calendar; without objection, it was so ordered.
Senator Shapiro requested unanimous consent to have Senator
Williams be shown voting aye on the following bills: SB 114,
CSSB 302, CSSB 528, CSSB 959, SB 996, SB 1146 & SB 1376 as
amended; there being no objection, it was so ordered.
There being no further business, at 4:04 p.m. Senator Shapiro
moved that the Committee stand recessed subject to the call of
the chair. Without objection, it was so ordered.
