         Pursuant to a notice posted in accordance with Senate Rule  
         11.18, a public hearing of the Standing Senate Subcommittee on  
         Higher Education was held on Monday, April 4, 2005, in the Betty  
         King Committee Hearing Room, 2E.20, at Austin, Texas.

         The chair called the meeting to order at 3:32 p.m.  The  
         following business was transacted: 
          
         The posting rule, Senate Rule 11.18, was suspended to hear the  
         following bill(s): SB 333. 
          
         There was no action taken for the following bill(s):   SB 333,  
         SB 530, SB 936, SB 722, SB 1227, SB 1553. 
          
         The chair laid out SB 157 and recognized the author, Senator  
         Fraser, to explain the bill.  Senator Janek sent up a committee  
         substitute; the chair recognized Senator Fraser to explain the  
         difference between the committee substitute and the bill as  
         filed.  The chair opened public testimony; there being no  
         witness cards, public testimony was closed.  Senator West moved  
         that SB 157 be left pending to await a quorum; without  
         objection, it was so ordered.   
          
         The chair laid out SB 1138 and recognized the author, Senator  
         Estes, to explain the bill.  Senator Janek sent up a committee  
         substitute; the chair recognized Senator Estes to explain the  
         difference between the committee substitute and the bill as  
         filed. Witnesses testifying and registering on the bill are  
         shown on the attached list.  The chair moved that the public  
         testimony be closed; without objection, it was so ordered.    
         Senator West moved that SB 1138 be left pending to await a  
         quorum; without objection, it was so ordered.  
  
         The chair laid out SB 1118 and recognized the author, Senator  
         Ellis, to explain the bill.  Witnesses testifying and  
         registering on the bill are shown on the attached list.  The  
         chair moved that the public testimony be closed; without  
         objection, it was so ordered.  Senator West moved that SB 1118  
         be left pending to await a quorum; without objection, it was so  
         ordered.   
          
         The chair laid out SB 927 and recognized the author, Senator  
         Ellis, to explain the bill.  The chair temporarily pulled down  
         the bill to await the arrival of witnesses. 
          
         Upon the arrival of a quorum, the clerk called the roll.  
          
         Senator Janek moved adoption of the committee substitute for SB  
         157; without objection, it was so ordered. Senator Janek moved  
         that SB 157 do not pass but that CSSB 157 be reported back to  
         the Full Committee with the recommendation that it do pass and  
         be printed.  The motion carried with a record vote of 4 ayes, 0  
         nay, 0 present not voting, and 2 absent. 
          
         Senator Janek moved adoption of the committee substitute for SB  
         1138; without objection, it was so ordered.  Senator Janek moved  
         that SB 1138 do not pass but that CSSB 1138 be reported back to  
         the Full Committee with the recommendation that it do pass and  
         be printed.  The motion carried with a record vote of 4 ayes, 0  
         nay, 0 present not voting, and 2 absent. 
          
         Senator Janek moved that SB 1118 be reported favorably to the  
         Full Committee with the recommendation that it do pass and be  
         printed.  The motion carried with a record vote of 4 ayes, 0  
         nay, 0 present not voting, and 2 absent.       
          
         The chair laid out SB 1643 and recognized Senator Zaffirini, in  
         the absence of the author, to explain the bill.  Witnesses  
         testifying and registering on the bill are shown on the attached  
         list.  The chair moved that the public testimony be closed;  
         without objection, it was so ordered.  Senator West moved that  
         SB 1643 be left pending; without objection, it was so ordered.   
          
         At 4:01 p.m. Senator Averitt assumed the chair.

         Committee with the recommendation that it do pass and be  
         printed.  The motion carried with a record vote of 4 ayes, 0  
         nay, 0 present not voting, and 2 absent. 
          
         At 4:38 p.m. Senator West resumed the chair.   
          
         Senator Averitt moved that SB 1193 be reported favorably to the  
         Full Committee with the recommendation that it do pass and be  
         printed.  The motion carried with a record vote of 4 ayes, 0  
         nay, 0 present not voting, and 2 absent.   
          
         At 4:39 p.m. Senator Averitt assumed the chair.   
          
         The chair laid out SB 1247 and recognized the author, Senator  
         West, to explain the bill.  Witnesses testifying and registering  
         on the bill are shown on the attached list.  The chair moved  
         that the public testimony be closed; without objection, it was

         committee substitute; the chair recognized Senator Lucio, Jr. to  
         explain the difference between the committee substitute and the  
         bill as filed.  Witnesses testifying and registering on the bill  
         are shown on the attached list.  The chair moved that the public  
         testimony be closed; without objection, it was so ordered.   
         Senator West moved that SB 801 and the committee substitute be  
         left pending; without objection, it was so ordered.   
          
         The chair laid out SB 315 and recognized the author, Senator  
         Lucio, Jr., to explain the bill.  Witnesses testifying and  
         registering on the bill are shown on the attached list.  The  
         chair moved that the public testimony be closed; without  
         objection, it was so ordered.  Senator West moved that SB 315 be

         The chair laid out SB 1226 and recognized the author, Senator  
         Shapiro, to explain the bill.  The chair recognized Senator  
         Shapiro to discuss Committee Amendment 1. The chair opened

         Amendment 1 be left pending; without objection, it was so  
         ordered.

         The chair laid out SB 132 and recognized Senator Shapiro, in the  
         absence of the author, to explain the bill.  The chair  
         recognized Senator Shapiro to discuss committee substitute for  
         SB 132 and to explain the different between the substitute and  
         the bill as filed. Witnesses testifying and registering on the
